TERMS OF USE — MYCOOKINGPALS

IMPORTANT: This document is the Terms of Use / Terms of Service for the MyCookingPals service (the "Terms"). On iOS, use of the MyCookingPals app may also be subject to Apple's Standard EULA and Apple's Usage Rules. These Terms do not replace Apple's Standard EULA unless you publish a Custom EULA in App Store Connect.
1) Who we are (Provider) and what these Terms cover
MyCookingPals (the "App") is a recipe sharing community app and related online services (together, the "Service").

By creating an account, subscribing, downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2) Eligibility and accounts
2.1 Minimum age
The Service is not intended for children under 16 (or the minimum age required in your country). If you are under the applicable minimum age, you may not use the Service.
2.2 Account registration
You must provide accurate information and keep it up to date. You are responsible for safeguarding your account and for all activity under your account.
2.3 Suspension/termination
We may suspend or terminate your account or access to the Service if you violate these Terms, to protect the Service or other users, or where required by law. You may stop using the Service at any time.
3) Your content (user-generated content)
The Service allows you to create, upload, store, import, and share content, including recipes, text, photos, notes, comments, and other materials ("User Content").
3.1 Ownership
You retain any rights you have in your User Content.
3.2 License you grant to us
To operate and improve the Service, you grant the Provider a worldwide, non-exclusive, royalty-free, transferable (only to service providers and in connection with a corporate transaction), sublicensable, and revocable (as described below) license to host, store, reproduce, adapt/format, translate, publish, display, perform, distribute, and make available your User Content to you and to others according to your settings and how the Service works.
3.3 Scope and revocation
This license is needed to run the Service (for example: storing recipes, showing your recipe feed, syncing across devices). If you delete specific User Content, we will stop using it under this license after a reasonable processing period, except:
- copies may remain in backups for a limited time,
- we may retain content where required by law, for security, fraud prevention, or dispute resolution,
- content shared with others may remain visible to them (for example if they saved it), depending on how the Service provides sharing.
3.4 Your responsibility for User Content
You are responsible for your User Content and for ensuring you have the rights to post it.
4) Acceptable use and community rules
You agree not to:
- Post content you do not have the right to use (copyright, trademark, trade secret, privacy/publicity rights).
- Post illegal, defamatory, harassing, hateful, violent, or sexually exploitative content.
- Post content that encourages dangerous activity (including unsafe food handling) or contains fraudulent or misleading claims (including medical claims).
- Attempt to access accounts or data that are not yours, interfere with the Service, or circumvent security.
- Use the Service to spam, scrape, or abuse other users.
5) Moderation, reporting, and removal
5.1 Enforcement
We may remove or restrict access to User Content and may suspend/terminate accounts that violate these Terms.
5.2 Reporting
If you believe content violates these Terms or is illegal, contact us at mycookingpals@pm.me with:
- a description of the issue,
- the relevant username/content link (if available),
- and any supporting information.
We may ask for additional information to process your report.
6) Recipe import, scraping, and third-party content
6.1 Import tools
The Service may allow you to import recipes from third-party websites or other sources. You are responsible for ensuring you have the right to import and store that content and for complying with any third-party terms.
6.2 Third-party links and services
The Service may link to external sites or services. We do not control and are not responsible for third-party content, policies, or practices.
7) Subscriptions, in-app purchases, and payments (Apple + Google)
7.1 Billing platforms
Paid features may be offered through Apple's App Store and/or Google Play (and may be managed through RevenueCat). Your purchase is handled by the relevant store, and your use is also subject to that store's terms.
7.2 Auto-renewal (if applicable)
If you start an auto-renewing subscription, it renews automatically unless you cancel in your Apple/Google account settings before the renewal date.
7.3 Managing and cancelling
You can manage or cancel subscriptions through:
- iOS: your Apple ID subscriptions settings
- Android: your Google Play subscriptions settings
Deleting the app does not automatically cancel your subscription.
7.4 Refunds
Refunds (if any) are handled by Apple or Google under their policies, unless mandatory law requires otherwise.
7.5 Changes
Subscription prices and offerings may change as permitted by the stores' rules and applicable law. We will comply with any notice requirements that apply.
8) Food safety, allergies, and medical disclaimer
The Service provides recipes and food-related content for informational purposes only.
- Always consider allergies, intolerances, and dietary needs. Ingredients and cross-contamination risks vary.
- Cooking involves risks (burns, cuts, choking, foodborne illness). Use appropriate care and hygiene.
- Nutrition information (if shown) may be estimated and may be inaccurate.
- The Service is not medical or professional advice. If you have a medical condition or questions, consult a qualified professional.
You use recipes and the Service at your own risk.
9) Intellectual property (our content and the app)
Except for User Content, the Service, app software, branding, and related materials are owned by the Provider or its licensors and are protected by intellectual property laws. You may not copy, modify, distribute, sell, lease, or reverse engineer the Service except to the extent permitted by applicable law.
10) Privacy
Our Privacy Policy explains how we collect, use, and share information. See: Privacy Policy — MyCookingPals. If there is a conflict between these Terms and the Privacy Policy about data practices, the Privacy Policy controls.
11) Service availability and changes
We may change, suspend, or discontinue parts of the Service, and we may update these Terms from time to time. If changes are material, we will take reasonable steps to notify you (for example, in-app notice). Your continued use after an effective date means you accept the updated Terms.
12) DISCLAIMERS
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM ALL WARRANTIES AND CONDITIONS, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Some jurisdictions do not allow certain disclaimers, so some of the above may not apply to you.
13) LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PROVIDER WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
Nothing in these Terms limits liability that cannot be excluded under applicable law (including certain consumer rights, and liability for intent or gross negligence where applicable).
14) Indemnity (where permitted)
To the extent permitted by law, you agree to indemnify and hold the Provider harmless from claims arising out of your User Content or your violation of these Terms.
15) Governing law, venue, and consumer rights
15.1 Governing law
These Terms are governed by Swiss law, excluding conflict-of-laws rules, and excluding the UN Convention on Contracts for the International Sale of Goods.
15.2 Venue
Subject to mandatory law, the courts of Solothurn shall have jurisdiction.
15.3 EU/EEA consumer savings clause
If you are a consumer habitually resident in the EU/EEA, you may benefit from mandatory consumer protection laws of your country of residence, and nothing in these Terms is intended to reduce those rights.
